Terms of Service

1. Who We Are and What RideTap Is

RideTap ("RideTap," "we," "us," or "our") is a software platform operated by Joe Jackson. RideTap provides tools that let independent transportation providers ("Drivers") create a shareable profile, receive booking requests from their customers, and manage those requests.

RideTap is a software tool, not a transportation provider. We do not own, operate, or provide any vehicles or transportation services. We do not employ Drivers. We do not dispatch, match, or assign rides. We do not set prices, process payments for rides, or participate in the arrangements Drivers make with their customers. Any booking, quote, payment, contract, or ride is solely between the Driver and their customer. RideTap is not a party to those arrangements.

By creating an account or using RideTap, you agree to these Terms of Service ("Terms"). If you do not agree, do not use RideTap.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use RideTap. By using RideTap you represent that you meet these requirements and that all information you provide is accurate.

3. Driver Accounts and Responsibilities

If you use RideTap as a Driver, you are an independent business, fully and solely responsible for your own operations. This includes, without limitation: holding and maintaining all licenses, permits, registrations, and authority required to operate your transportation business; carrying all insurance required by law and appropriate to your services; the condition, safety, maintenance, and legal operation of your vehicles; setting your own prices and honoring your own quotes, bookings, and commitments; your conduct toward, and all dealings with, your customers; collecting payments and handling deposits, refunds, and disputes directly with your customers (RideTap does not process ride payments); and complying with all laws applicable to your business, including tax, labor, transportation, and consumer-protection laws.

You are not an employee, agent, partner, or joint venturer of RideTap, and nothing in these Terms creates such a relationship. RideTap does not screen, vet, endorse, verify, or guarantee any Driver, and does not represent that any Driver is licensed, insured, qualified, or safe.

4. Content You Provide

You are responsible for all content you upload or display through RideTap, including your profile information, vehicle details, service descriptions, pricing text, testimonials, and photos ("Your Content").

You represent and warrant that, for all of Your Content, you either own it or have all rights and permissions necessary to use and display it — including, where the content shows or identifies other people (for example, photos of your customers or past rides), the consent of those people to have their image used and displayed publicly.

You grant RideTap a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute Your Content for the purpose of operating and providing the service (for example, showing your profile to your customers and generating link previews).

You must not upload content that is unlawful, infringing, deceptive, or that you do not have the right to share. We may remove content or suspend profiles that we believe violate these Terms or that are reported to us, at our discretion, including for suspected fraud or impersonation.

5. Bookings Happen Off-Platform

Booking requests submitted through a Driver's profile are simply messages passed to the Driver. RideTap does not confirm, guarantee, or take responsibility for any booking, availability, quote, deposit, ride, cancellation, no-show, or refund. All of that is arranged and handled directly between the Driver and their customer. If a ride does not happen as expected, or a dispute arises, it is between the Driver and their customer — not with RideTap.

6. Customer Use

If you submit a booking request through a Driver's RideTap profile, you understand that your request goes to that Driver directly and that your booking, if any, is with that Driver — not with RideTap. RideTap does not vet Drivers and is not responsible for the services any Driver provides. We recommend confirming details directly with the Driver and using caution before sending any deposit or payment.

7. Subscriptions and Billing

RideTap offers a free tier and a paid "Pro" subscription. Paid subscriptions are billed through the Apple App Store under Apple's terms, including any free-trial and auto-renewal terms disclosed at purchase. You manage and cancel your subscription through your App Store account settings. Except where required by law, subscription fees are non-refundable. We may change our pricing or features on a going-forward basis with reasonable notice.

Any physical products we may offer (such as branded tap cards) are sold separately and are subject to the terms presented at the time of purchase.

8. Acceptable Use

You agree not to: use RideTap for any unlawful, fraudulent, or deceptive purpose; impersonate any person or business; upload content you lack the rights to; attempt to disrupt, reverse-engineer, or gain unauthorized access to the service; or use the service to harass or harm others. We may suspend or terminate accounts that violate these Terms.

9. Disclaimers

RideTap is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any Driver or customer is trustworthy, qualified, or safe. To the fullest extent permitted by law, we disclaim all responsibility for the acts, omissions, conduct, vehicles, services, or safety of any Driver or customer.

10. Limitation of Liability

To the fullest extent permitted by law, RideTap and Joe Jackson will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the service — including, without limitation, anything arising from a ride, booking, vehicle, accident, injury, property damage, no-show, cancellation, payment, or dispute between a Driver and a customer.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service will not exceed the greater of (a) the amount you paid us for the service in the twelve (12) months before the claim, or (b) fifty U.S. dollars ($50).

11. Indemnification

You agree to defend, indemnify, and hold harmless RideTap and Joe Jackson, and our respective owners, employees, and agents, from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the service; (b) Your Content; (c) your transportation services, vehicles, bookings, or dealings with customers or other third parties; (d) your violation of these Terms; or (e) your violation of any law or the rights of any third party. This section survives termination of your account.

12. Termination

You may stop using RideTap and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, including for violations of these Terms or suspected fraud. Sections that by their nature should survive (including Content license grants already made, Disclaimers, Limitation of Liability, and Indemnification) survive termination.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Your continued use after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. You agree that any dispute will be brought in the state or federal courts located in Nevada, and you consent to their jurisdiction, except where applicable law provides otherwise.
